These Terms of Service ("Terms") explain how AC Commander Services ("AC Commander Services," "we," "us," or "our") provides HVAC installation, repair, and maintenance services, dumpster rentals, and hauling/junk removal services in and around San Antonio, Texas. By using our website, requesting a quote, scheduling a service, or paying for any service, you are agreeing to these Terms.

1. Acceptance of These Terms

By accessing our website or using any of our services, you confirm that you:

  • Have read and understand these Terms;
  • Are at least 18 years of age or legally able to enter into contracts in your state; and
  • Agree to follow these Terms and any written service agreements, estimates, or work orders we provide.

If you do not agree to these Terms, please do not use our website or schedule any services with us.

2. Services We Provide

AC Commander Services provides the following services in the San Antonio, Texas area:

  • HVAC installation, repair, and maintenance for heating, ventilation, and air conditioning systems;
  • Dumpster rentals for residential and commercial use; and
  • Hauling and junk removal services.

The exact details of any job—including the scope of work, price, schedule, and any special conditions—will be listed in an estimate, work order, invoice, or other written agreement we provide to you. That written document, together with these Terms, will control how the service is performed.

3. Use of Our Website

Our website is intended to share information about our HVAC, dumpster rental, and hauling/junk removal services and to help you contact us or request service. You agree to use the website only for lawful purposes and in a way that does not harm us or other users.

You agree that you will not:

  • Use the website in any way that breaks local, state, or federal law;
  • Try to access any part of the website, our systems, or our data without permission;
  • Send or upload viruses, malware, or other harmful code;
  • Use automated tools (such as bots, scrapers, or data-mining tools) without our written permission; or

4. Service Agreements and Your Responsibilities

By requesting or accepting services, you agree to:

  • Provide accurate and complete information about your property, equipment, and the items or materials to be removed or placed in a dumpster;
  • Ensure safe and clear access to the work area, dumpster placement area, and any areas where items will be moved or hauled from;
  • Follow any instructions we give about safely operating and maintaining your HVAC equipment, using dumpsters correctly (including not placing prohibited items in them), and safely handling hauling or junk removal activities; and
  • Review and approve the estimate or work order before we start work, when required.

Some services may require permits, inspections, or approval from your city, county, or other local authority. Unless we specifically say in writing that we will handle permits or inspections, you are responsible for obtaining all necessary approvals and for following local building codes, zoning rules, and regulations that apply to dumpster placement and hauling.

5. Estimates, Scheduling, and Cancellation Policy

Any estimate we provide—whether through the website, by phone, text, email, or in person—is based on the information we have at the time. Unless we clearly state in writing that an estimate is a fixed or guaranteed price, it is only an estimate. The final price may change based on actual site conditions, the real volume or type of material to be hauled or disposed of, additional work you request, or other factors discovered at the time of service.

We will do our best to schedule service, delivery, and pickup at times that work for you. However, all appointment times and service windows depend on availability and may be affected by traffic, weather, disposal facility hours, equipment issues, or other circumstances we cannot control.

We reserve the right to reschedule or cancel a service, delivery, or pickup if we encounter unsafe conditions, blocked or limited access, equipment problems, or emergencies. If this happens, we will make a reasonable effort to contact you and set a new time.

If you need to cancel or reschedule, please contact us as early as possible. We may charge a fee if a service is canceled or changed on short notice, especially if we have already dispatched a truck or crew, delivered a dumpster, or purchased materials for your job. Any such fees will be described in your estimate, work order, or invoice where applicable.

6. Payment Terms

Payment terms for HVAC services, dumpster rentals, and hauling/junk removal services will be listed in your estimate, work order, or invoice. Unless we clearly state otherwise in writing:

  • Payment for most services is due when the work is completed; and
  • Some services, such as certain dumpster rentals or large installation projects, may require payment in advance or a deposit before we begin work or deliver equipment.

We may accept different forms of payment, such as cash, check, credit or debit cards, or electronic payments. The payment methods we accept will be shown on your invoice or explained at the time of service.

If payment is late or not made, we may:

  • Charge late fees or interest as allowed by law;
  • Refuse to schedule or perform additional services, including HVAC work, dumpster deliveries or pickups, and hauling/junk removal, until all amounts due are paid; and
  • Use collection methods that are allowed by law, including working with a collection agency or filing a legal claim.

7. User Information and Communications

When you submit a contact form, request a quote, or schedule a service, you agree to provide accurate and current information so we can reach you and properly perform the work. You allow us to use your contact details (such as phone number and email address) to respond to your questions, confirm appointments or deliveries, send service updates, and follow up about your services.

If we provide online accounts or portals in the future, you will be responsible for keeping your login information private and for all activity that takes place under your account. Please tell us right away if you believe your account has been used without your permission.

8. Third-Party Websites and Resources

Our website may include links to other websites or services run by third parties. These links are provided for convenience only. We do not control these websites and are not responsible for their content, products, services, or privacy practices.

To the fullest extent allowed by Texas law, AC Commander Services and our owners, employees, and contractors will not be responsible for any indirect, special, incidental, or consequential damages that result from your use of our website or our HVAC, dumpster rental, or hauling/junk removal services. This includes, for example, loss of income, loss of business, or damage to reputation, even if we have been told such damages were possible.

Our total liability for any claim related to these Terms, the website, or the services we provide will not be more than the amount you paid us for the specific service that led to the claim, or one hundred dollars (US $100), whichever is greater, unless a higher limit is required by law.

Some areas do not allow certain limits on damages. If that applies to you, the limitations in this section will apply only to the extent allowed by law.

11. Indemnification

You agree to protect, defend, and hold harmless AC Commander Services and our owners, employees, contractors, and agents from any claims, losses, damages, or expenses (including reasonable attorney’s fees) that result from: (a) your use of our website or services; (b) your violation of these Terms; or (c) your violation of someone else’s rights.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Any dispute or legal action related to these Terms, our website, or our services must be brought in the state or federal courts located in Bexar County, Texas. By using our website or services, you agree to the authority of these courts and to this location.

14. Severability

If any part of these Terms is found to be invalid or unenforceable, that part will be applied as much as the law allows, and the rest of the Terms will remain in full force and effect.

15. Entire Agreement

These Terms, together with any written service agreements, estimates, or work orders between you and AC Commander Services, make up the full understanding between you and us about your use of our website and our HVAC, dumpster rental, and hauling/junk removal services. They replace any earlier written or verbal discussions or agreements on these topics.
